Unlike other Australian states, in Tasmania there is no interlocutory division between the Supreme Court and the Magistrates Courts (e.g. a “district court” or a “county court”). [6] Van Diemen`s Supreme Land Court (as Tasmania was then called) was created by the Royal Letters Patent of 13 October 1823 and became operational on 10 May 1824. [1] The Court is the oldest Supreme Court in Australia and older than the Supreme Court of New South Wales, although only by a period of ten days. The Supreme Courts of Tasmania and New South Wales were created by the New South Wales Act 1823, which gave these courts jurisdiction over New Zealand. [2] Sir John Pedder, after whom Lake Pedder is named, was the first Chief Justice of the Court. FACE MASKS: Face masks must be worn in courthouses at all times by anyone over the age of 12.

Please bring a face mask to court. An exemption may apply if medical evidence is provided. The following hearing lists are posted daily at approximately 4:30 p.m. on this website. Appeals by the Appeals Division of the Court are brought before the High Court of Australia. It was previously possible to challenge decisions of the Court of Appeal or the Court of Criminal Appeal (both parts of the Appeal Division) to the Privy Council of the United Kingdom, but this ended in 1986 when the Australian Parliament passed the Australia Act 1986, which excluded all such appeals to the Privy Council of the Australian courts. The Supreme Court of Tasmania is the highest court in Tasmania, Australia. In the Australian judicial hierarchy, the Supreme Court of Tasmania is at the intermediate level, with both jurisdiction to appeal to the lower courts and to court decisions heard on appeal by the High Court of Australia. It has unlimited jurisdiction within the State in civil matters and hears the most serious criminal cases. This is roughly the middle of the Australian judicial hierarchy. The Supreme Court consists of a trial division (also called a court of first instance) and an appellate division (or Court of Appeal). [4] In its appellate body in civil cases, it is the “plenary”; for criminal cases, this is the Tasmanian Court of Criminal Appeal.

[5] In February 2021, LGBTQI+ media reported to the Star Observer that Tasmania had never officially recognised same-sex relations following a Tasmanian Supreme Court ruling. [10] [11] [12] Civil cases involving consent orders or disputes involving a value of less than $50,000 are dealt with by the Magistrates Court, except in exceptional cases. The procedures used in criminal cases to determine whether there is sufficient evidence against an accused to justify the length and cost of a trial were abolished in Tasmania in 2000 with the amendment of the Justice Act 1959 (CAS). The Justice Act 1959 now provides that if an accused has pleaded not guilty, he or she must be sentenced to trial by the Supreme Court.
